SUNDAY STUDY: Evil of Margaret Sanger’s Eugenics Designs

Jay Sekulow is Chief Counsel of the American Center for Law and Justice (ACLJ), one of the most prestigious law firms in the country. He is a self-described Messianic Jew, a senior adviser on President Donald Trump’s personal legal team, an accomplished Supreme Court advocate, and renowned expert on religious liberty.

The ACLJ is also dedicated to combating the injustice of denying human rights to unborn children and has filed as amicus in previous abortion cases in the Supreme Court.

Recently, they filed regarding two abortion regulations in Indiana:

  1. To set requirements for the humane disposition of fetal remains.

Indiana has taken the straightforward step of, as the Seventh Circuit panel phrased it, “essentially requiring] abortion providers to dispose of aborted fetuses in the same manner as [other] human remains, as required under Indiana law.”

Since “aborted fetuses” are “human remains,” this makes perfect sense. The Seventh Circuit disagreed with this reasoning, perceiving a constitutional difficulty in any “recognition that aborted fetuses are human beings, distinct from other surgical byproducts, such as tissue or organs.”

Abortionists could not “treat the bodies of dead unborn children as just so much ‘medical trash.’” The lower court somehow found this to violate the Supreme Court’s abortion cases, but the Supreme Court strongly disagreed.

2. the other regulation prohibits the abortion of a child when done for certain invidiously discriminatory reasons (e.g., sex, race, disability).

Justice Clarence Thomas wrote a concurring opinion that powerfully reveals the ugly eugenics movement in the United States and its connection to abortion as a eugenic tool. According to Justice Thomas, Planned Parenthood, the organization which Margaret Sanger founded (originally called the American Birth Control League), furthered Sanger’s eugenic aims.
